CAFCASS introduces the "Domestic Abuse Practice Policy: Prioritizing Child Safety and Survivor Support"

In October 2024, Cafcass introduced a comprehensive Domestic Abuse Practice Policy, further refined in January 2025, to enhance the protection of children and adult survivors in family court proceedings.
This policy mandates that Family Court Advisers (FCAs) and Children’s Guardians place the child’s experience and safety at the forefront, especially in cases involving domestic abuse.
Key Highlights of the Policy
1. Children Recognized as Victims
Aligning with the Domestic Abuse Act 2021, the policy acknowledges that children who see, hear, or experience the effects of domestic abuse are victims themselves.
2. Comprehensive Assessment of Abuse
Practitioners are required to conduct thorough analyses of abuse allegations, considering the history, patterns of behavior, and any potential risks to the child and the non-abusive parent.
3. Trauma-Informed Language
The policy emphasizes the use of accurate, trauma-informed language. Practitioners must use the exact words of victims in reports, avoiding terms that minimize the abuse, such as replacing “rape” with “non-consensual sex.”
4. Addressing ‘Parental Alienation’ Claims
The policy requires that if a child resists contact with a parent, the possibility of domestic abuse should be considered before attributing it to “parental alienation.”
5. Accountability and Oversight
Cafcass staff are held accountable for adhering to the policy, with mechanisms in place for complaints and reviews if the guidelines are not followed.
Inclusivity for Neurodiverse Families
The policy underscores the importance of considering the unique needs of neurodiverse families, including those with autistic members. Practitioners are encouraged to:
Recognize diverse communication styles and sensory sensitivities.
Avoid misinterpreting behaviors as non-compliance or defiance.
Ensure that assessments and recommendations are tailored to the individual’s needs.
